A man was sentenced today to eight years in jail and $1.3 million in restitution after a federal judge ordered him to pay restitution for the destruction of a $2 million worth of pharmaceuticals that were allegedly used to treat erectile dysfunction. The defendant was sentenced to two years in federal prison, which was suspended for a year after he pleaded guilty to one count of making a false and misleading representations to a federal grand jury concerning a health condition known as impotence and for making a false and misleading representation that he had the power to make a tax assessment or tax return for a specific year.
“The defendants are liable for restitution for the destruction of the counterfeit drugs and are in the best interest of the public,” said John S. Foy, Special Assistant United States Attorney for the District of New York.
Foy’s office was established in 1989 as an investigator for a federal grand jury in New York for the first time and began investigating the illegal trade in the drug sildenafil citrate, commonly known as Viagra, in 1997. In 2003, the U. S. Department of Justice (DOJ) announced it was considering a criminal investigation of the sale of counterfeit prescription medications for the treatment of erectile dysfunction. The case was prosecuted by Assistant U. Attorney Richard A. Lechleiter and Special Assistant United States Attorney Steven E. Kiehl.
The federal government alleged that the drugs were used by a man for a variety of purposes that resulted in his death.
The defendant had no financial ties to the U. government and did not have any government-issued government-funded programs or medical devices for erectile dysfunction. He had no connection to any drug companies, except for the manufacturer of Viagra and Cialis.
Foy said that the defendants received a report from the FDA on the counterfeit versions of the medications. He said the FDA was aware of the case and would be monitoring it.
“We are not aware of the defendants’ intent to sell counterfeit drugs,” Foy said. “The defendants were responsible for destroying and/or selling the counterfeit drugs. The defendant had no relationship to the FDA or any government-funded pharmaceutical agency.

In a statement to the Federal Trade Commission (FTC), the defendant’s attorney, John J. Hester, said the information he received about the counterfeit drugs was “very concerning.”
“I am hopeful that this defendant will continue to live with his wife and his son. This is a very difficult and very hard course,” Hester said. “It’s sad and very concerning. I am hopeful that he will continue to live with his wife and their son, and that his children will be safe and healthy. I am hopeful that his life will be a success in the future and that he will continue to live with his wife and family.”
